1 General

The following terms and conditions apply to purchases made by a customer (hereinafter referred to as “the Buyer”) on the website www.eeje.be. In the case of a purchase, the Buyer accepts these general terms and conditions without any reservation. The Seller reserves the right to amend the general terms and conditions at any time.

The Seller makes every effort to update and/or supplement the content of www.eeje.be as often as possible. Despite this care and attention, it is possible that content is incomplete and/or incorrect.

The products offered on  www.eeje.be  are offered without warranty of any kind or claim to accuracy. These products  may change at any time without prior notice from the Seller.

Specifically for prices and other information about products on www.eeje.be, there is a reservation for obvious programming and typing errors. You may not claim an agreement with the Seller based on such errors.

All prices are stated inclusive and exclusive of VAT and without shipping costs. All shipping costs are stated separately on the order confirmation, as well as the total price of the order.

 

  1. Purchase agreement

A purchase agreement exists when the Buyer confirms his purchase via the web shop AND has paid the full purchase price (products and additional costs such as shipping costs) to the account of the Seller.

The Buyer is at all times entitled to cancel his purchase within 14 calendar days after delivery of the product as described below under Article ‘3. Right of withdrawal’.

At the time of delivery, the Buyer will always be informed of the identity of the seller, his address, the characteristics of the product, the price, the delivery costs, the right of withdrawal, the contact details to which the Buyer can turn with complaints, information about the existing after-sales service and guarantees.

The Seller has the right not to proceed with the purchase agreement if the Client is unable to fulfil his payment obligation. The Seller can refuse the order or attach special conditions to the execution of the order if there are facts or factors that are important for a responsible conclusion of the purchase agreement.

 

  1. Right of withdrawal

The Buyer is at all times entitled to cancel his purchase within 14 calendar days after delivery of the product. He is not fined for this and does not have to give a reason for this. This revocation must be done in writing (by e-mail or letter). In this case, the Buyer must return the product within 14 calendar days from the date of withdrawal, in the original packaging, in undamaged and unused condition. Return shipments are at the expense and risk of the Buyer. Because return shipments also generate an extra handling costs for the Seller, a fixed return fee of €25 is charged in addition to the cost of the shipment. Non-notified return shipments will not be credited.

Products returned under the conditions described above, will be refunded by Seller within thirty days of their return. The refunded amount includes the full initial purchase price without the initial shipping costs, minus €25 return charge, minus the cost of the return shipment (if requested by the Seller from the carrier).

The Seller reserves the right to refuse return shipments if he suspects that a product has been used or if it is suspected of being damaged after delivery of the product. In this case, the Seller will make an adjusted proposal for a lower amount to be reimbursed.

 

  1. Personal data and privacy

The personal data of the Buyer are used for the confirmation, invoicing and delivery of his order.

When placing an order, the Buyer is at all times responsible for the correctness of the data. In case of errors in the address, billing or other personal data, the Seller can under no circumstances be held liable for the impossibility of fulfilling his obligations (for example delivery or notification).

Subscribers to the newsletter (the Subscriber) will be informed of novelties on  www.eeje.be   and other initiatives of the Seller. You can unsubscribe from the newsletter at any time. For the newsletter, only the entered e-mail address is kept.

Personal data will not be passed on, rented or sold to third parties. The Seller strictly respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data and the General Data Protection Regulation (GDPR).

By agreeing to the general terms and conditions of sale, the Buyer declares to be 18 years of age or older.

The processed data include the Buyer’s name, address, telephone number and e-mail address (and VAT number if applicable). This information is necessary for the delivery of the product. The address details will be passed on to the logistics partner who will deliver the ordered products. The entered data will be removed from the web files 3 months after delivery of the purchased products at the latest. The invoicing details are mentioned on the invoice.

Payment shall be made via the secure website of the payment processor and the website of the Buyer’s bank. In case of a payment, the account number of the Buyer becomes visible to the Seller. This is useful in case of reimbursement.

Each Buyer or Tenderer has the right, after verification of his identity, to request, by registered letter to the address of the Seller, access to the personal data processed and, if necessary, to request its correction or omission. In case of discussion, the Buyer can contact the Privacy Commission (www.privacycommission.be).

 

  1. Shipping costs

Shipping costs are always clearly stated on the order confirmation and/or on the invoice.

The shipping costs are determined by the amount of the order, depending on the weight or the number of items ordered. The Seller has the right to adjust the shipping rate if necessary. If the shipping costs are unexpectedly higher, the Seller will inform the Buyer of this before delivery. The shipment will continue after payment of the additional costs to the Seller. If the Buyer cancels his purchase, the amount already paid will be refunded within 30 calendar days.

 

  1. Delivery

The intended delivery time is 10 working days. This presupposed delivery period is purely indicative. The Seller cannot be held liable for delays.

If a returned shipment has to be reshipped, the Seller will be obliged to charge the shipping costs, even if the initial order was shipped free of charge.

According to the law, the maximum delivery time is 30 days. If this delivery period is not feasible, the Seller shall notify the Buyer in good time and the Buyer shall have the right to cancel the order, at no additional cost. In that case, any amounts already paid will be refunded within 30 days.

 

  1. Liability for transport damage

All items are checked before shipping. The Buyer undertakes to check the order immediately upon receipt and to inform the Seller immediately of any damage. This can be done by email, preferably with a picture of the damaged article.

 

  1. Payment

Payment to the Seller is made via the payment options offered on www.eeje.be. After receipt of payment, the ordered items will be sent to the Buyer.

 

  1. Warranty on the POO-PEE-DO® dog toilet

There is a 3-year warranty on the parts under normal use of the Poo-Pee-Do. The guarantee starts on the date of purchase and applies to damage that prevents the normal functioning of the Poo-Pee-Do. The guarantee does not apply to aesthetic damage, normal wear and tear or deliberately applied damage. This guarantee never forms the basis for exchanging or returning the complete Poo-Pee-Do.

If the Buyer fails to teach the dog to Poo-Pee-Do, this is not a basis to invoke this guarantee. This is not due to a fault in the production of the Poo-Pee-Do dog toilet.

Where the warranty applies, a spare part will be sent free of charge to replace the failing part. Any assembly must be carried out by the Buyer himself. After replacement, the term of the guarantee does not start again, neither on the whole nor on the replaced part.

 

  1. Ownership rights and copyright

The Seller retains full ownership of a sold item until the purchase price has been paid in full.

All intellectual property rights relating to the products and images thereof are vested in the Seller. Copying, distribution and any other use of these materials is not permitted without the written permission of the Seller, except and only to the extent provided otherwise in regulations of mandatory law (such as the right to quote), unless otherwise indicated for specific materials.

 

  1. Other

All agreements between the Seller and the Buyer are governed by Belgian law.

The Seller can never accept liability for hyperlinks to websites or services of third parties included on www.eeje.be

 

This purchase agreement may change from time to time.
